1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the Alesta websites, applications, and APIs (the "Service") operated by ModulexAI, LLC ("Alesta," "we," "us," "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization, and "you" means that organization.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract. You are responsible for the confidentiality of your credentials and for everything that happens under your account, and you agree to notify contact@alesta.ai promptly of any suspected unauthorized access. Keep your account information accurate; billing and legal notices go to the email on the account.

3. The Service and what you may submit to it

Alesta is an analysis service: you supply a website domain, and the launch profile gathers available public information about that domain and its competitive context, measures it, and produces analyses and written documents from what it finds. The launch profile reads public web pages and public data sources within the limits of our data providers. Optional connected capabilities, if available and authorized by you, may process additional data under their stated access terms.

You may submit a domain you own or operate, or one you have a legitimate business interest in assessing (a competitor, a prospect, an acquisition target). You may not use the Service to harass, to stalk or profile individuals, or as part of any attempt to attack, overload, or gain unauthorized access to any site. We may decline or stop analyses of a domain at our discretion, including at the request of the domain’s owner.

We improve the Service continuously; features may change, and analyses may differ between runs as measurements, data sources, and models evolve.

4. Plans, billing, and credits

We offer free and paid plans. Paid subscriptions are billed through Stripe and renew automatically until you cancel from your account settings or by writing to contact@alesta.ai; cancellation takes effect at the end of the then-current billing period. Except where the law requires otherwise, fees are non-refundable.

The initial domain-first profiling run is zero-rated and available once for an eligible workspace. Credits meter eligible paid workspace actions. Plans differ in capacity and access, and an entitlement does not make every capability or provider universally available. We may change prices and plan contents with notice; changes apply from your next billing period. You are responsible for applicable taxes.

5. Your content and your outputs

You retain all rights in what you submit to the Service. You grant us a limited, worldwide license to host and process it solely to provide and maintain the Service as described in our Privacy Policy.

The analyses, scores, and documents the Service generates for your workspace ("Outputs") are yours to use for any lawful purpose. Because Outputs are produced by automated analysis of public data, they are not exclusive: an analysis of the same domain for another customer may be similar or identical.

No training. We do not use your private account data or workspace Outputs to train a proprietary Alesta model. Third-party model handling and retention are governed by the provider configuration and applicable provider terms.

6. Acceptable use

  • Do not use the Service in violation of any law or regulation.
  • Do not interfere with or disrupt the Service, probe or test its security without written permission, or circumvent usage limits, credit metering, or plan gates.
  • Do not resell, redistribute, or systematically extract the Service’s underlying third-party data feeds as a dataset; Outputs are for your use, not for rebuilding a data product.
  • Do not use the Service to develop a competing analysis product by systematically harvesting its Outputs.
  • Do not submit domains as part of any scheme to harass, defame, or harm the site’s operator or any individual.

7. Analyses, AI, and no professional advice

The Service’s measurements depend on third-party data sources, and its written analyses are produced in part by AI models. Outputs can be incomplete, out of date, or wrong, and web data itself shifts constantly. Review Outputs before acting on them, and treat them as informed input to your judgement, not a substitute for it.

Outputs are provided for general informational purposes. They are not legal, financial, investment, or other professional advice, and the Service makes no promise that following them will improve rankings, traffic, visibility, revenue, or any other outcome.

8. Third-party services and data

The Service is built on third-party providers (including measurement, search-data, crawling, AI-model, authentication, and payment providers, listed in the Privacy Policy). Their availability is outside our control; when a provider is degraded or unavailable, parts of an analysis may be delayed, partial, or missing. Your use of any third-party service through your own account with that party (for example Stripe’s payment pages) is governed by that party’s terms.

Connecting your own accounts. You may connect accounts you hold with third-party services, such as Google Analytics and Google Search Console. You start each connection yourself through that provider’s authorization screen, which shows the access being requested before you grant it. You can revoke a connection at any time, either in the application’s settings or from your account with the provider. Access tokens are stored encrypted and are deleted when the connection is removed.

You are responsible for holding the rights necessary to connect an account and to let the Service read the data it exposes, including any permission your organization requires you to obtain first. A connected service stays governed by that provider’s own terms, and what the Service reads from a connection, stores, and retains is set out in the Privacy Policy.

9. Intellectual property

Alesta and its licensors own all right, title, and interest in the Service, including its software, models of operation, UI, and documentation. You may not use our trademarks without prior written permission. If you send us feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without obligation to you. Other than the limited rights expressly granted in these Terms, no rights are granted by implication.

10. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALESTA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF OUTPUTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALESTA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE OR ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ALESTA IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

12. Indemnification

You will indemnify, defend, and hold harmless Alesta and its officers, directors, employees, and agents from any third-party claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, the domains you submit, your use of Outputs, or your violation of these Terms or applicable law.

13. Term, suspension, and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, for abuse of the Service or its data providers, or where required by law; where practical we will notify you first. On termination, your right to use the Service ends and data deletion follows the retention terms in the Privacy Policy. Sections that by their nature survive (including 5, 7, and 9 through 15) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. Before filing a claim, contact us at contact@alesta.ai and give us 30 days to try to resolve the dispute informally. Unresolved disputes belong to the state or federal courts located in Delaware, and both parties consent to personal jurisdiction and venue there, except where mandatory consumer-protection law in your jurisdiction requires a different forum.

15. Changes to these Terms

We may update these Terms as the Service evolves. Material changes are announced on the site or by email before they take effect; continued use of the Service after the effective date constitutes acceptance. The dates above always reflect the current version.
